As a sort of follow-on from the previous chart run post, I put this together before that post.  It doesn’t provide a definitive answer to the whole copyright aspect of charts on websites, but explains my reasoning for re-instating the search in a round-about way…

Some of you may have noticed that the chart run search is back.  Below are some of the reasons for this:

– As far as I know emails from the Official Charts Company (OCC) were sent to only two sites.  These sites have so far complied with the request.  However, they have asked the OCC questions, to which they have received no reply, now over a month later.  (I did not receive such an email myself.)  These emails were mainly concerned about the copyright on the data being infringed, and the being used without a licence - no details of which were included in the email, and something which the OCC seems to be a bit hazy about.

– As far as I can see from my basic reading of copyright, what I am doing by presenting the charts runs via a search engine, does not breach the copyright. As the sites that received the emails were publishing the charts in the same format the OCC publishes them (i.e. position, lw, title, artist) the OCC may be correct in applying copyright to the format of the data.  I have taken the data (which I can keep in a database for personal use, according to copyright law) and presented this in a way which does not resemble the format the OCC use - chart runs.  Sure, the title and the artist are the same, but obviously these names do not belong to the OCC.

Therefore the chart run searches will be back for now, and will continue until I hear otherwise from the OCC.

I thought it was time for a new theme on the blog, so here it is! It should be slightly friendlier to Pocket PC users as I no longer have the menu at the top.

When leaving comments, I’ve implemented a captcha-style verification image which should also reduce spam. You’ll get this everytime you leave a post, unless you register. Also appearing on comments are some icons. At the moment, if you are registered with gravatar and use the same email address for posting, your icon should appear. However, as gravatar seems to be having problems, I may get rid of this and implement something like ‘favatars’ instead.

Any problems with the new layout, let me know and I’ll sort them out!

After years of running a website, this month I have finally managed to use 1Gb of bandwidth, through visitors using the site - mainly for the chart runs bit… Just got to think of more things to keep people coming back for more.

Normal service will be resumed shortly after I catch up on two weeks of data - although I probably won’t comment on the weeks I’ve missed!

An article popped up on BBC this morning about ntl and their plans for the near future.  The good news is that all users will be upgraded to 10Mb by the end of 2006 - all at no extra cost!  This can only be good for XBox live sessions where it still sometimes struggles with my current 2Mb connection. 

Of course, now I can’t wait, but our current speed works perfectly fine for browsing the web and email etc.  The extra speed will help downloading and streaming - the reason for also increasing the cap to 75Gig a month.

However, there is no mention of upload speeds increasing…  I hope they will, as that is probably the bottleneck for online gaming with ntl.
